Terms of Service

1. The service

Foodie Adventure Passport ("FAP") is a paid subscription that gives members access to buy-one-get-one and similar dining offers at participating restaurants in the Raleigh-Durham-Cary Triangle area. By creating an account or subscribing you agree to these terms.

2. Subscriptions & automatic renewal

Auto-renewal disclosure: Passport subscriptions renew automatically — monthly plans each month and annual plans each year — at the then-current price, charged to your payment method on file, until you cancel. You can cancel at any time; cancellation takes effect at the end of the current billing period and you keep access until then. We will notify you before any price increase.

• Payments are processed by Stripe. We never store your card details.
• Except where required by law, payments are non-refundable once a billing period has started.
• Promotional pricing applies for the stated promotional period only, after which the standard rate applies.

3. Using offers

• Offers are for in-venue dining by the subscribing member unless the offer states otherwise.
• Each offer shows its own rules: usage frequency (e.g., once per subscription year), required purchases, valid days, and blackout dates. The rules shown in the app at redemption time control.
• Redemption codes are single-use and expire 5 minutes after they are generated. Only tap Redeem in front of restaurant staff.
• Gratuity is not included. We ask members to tip on the full pre-discount amount.
• Offers have no cash value and cannot be combined with other promotions unless the restaurant says so.

4. Fair use & account integrity

One account per person. Sharing accounts, reselling redemptions, manipulating quests, streaks, or the leaderboard, or attempting to redeem outside a participating venue may result in suspension or termination without refund. We log redemption attempts for fraud prevention.

5. Restaurants are independent businesses

Participating restaurants set their own menus, hours, and offer terms and may join or leave the program at any time. FAP is not responsible for the food, service, or premises of any restaurant. The set of participating restaurants will change over time, and no specific restaurant's continued participation is guaranteed.

6. Gamification & prizes

Quests, badges, XP, and streaks are provided for fun and have no cash value. Physical or gift-card prizes, where offered, are subject to availability, are non-transferable, and claim codes expire 30 days after issue unless stated otherwise.

7. Termination

You may delete your account at any time in Account settings. We may suspend or terminate accounts that violate these terms. If we terminate your account without cause, we will refund the prorated unused portion of your current billing period.

8. Disclaimers & limitation of liability

The service is provided "as is." To the maximum extent permitted by law, FAP's total liability for any claim related to the service is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, or consequential damages.

9. Governing law

These terms are governed by the laws of the State of North Carolina. Disputes will be resolved in the state or federal courts located in Wake County, North Carolina.

10. Changes

We may update these terms; material changes will be announced by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
